What is a commercial EPC ?

The Commercial Energy Performance Certificate provides information regarding the energy efficiency of the particular property. This also includes a recommendation report for improving the energy efficiency of the property, allowing the new owners/tenants to make an informed decision on the carbon consumption and how to make any potential savings on their energy costs.

Current Commercial EPC legislation

  • As of 4th January 2009, all commercial property for let or sale now require a commercial Energy Performance Certificate. It is now mandatory that an EPC is in place prior to marketing a commercial property.
  • The commercial epc certificate informs you how energy efficient the commercial property is on a scale of A-G, A - being the most efficient. It also informs you on a scale of A-G about the impact the property has on the environment.
  • Newly constructed commercial buildings also require an EPC.
  • Commercial Energy Performance Certificates are valid for 10 years.
  • Non-compliance with commercial epc certificate legislation can result in penalties of 12.5% of the rateable value of the property. Minimum £500 to maximum £5,000.

Exemptions regarding commercial energy performance certificates

  • Lease renewals or extensions that were in place prior to 1st October 2008.
  • Places of worship.
  • Stand alone buildings less than 50 square metres.
  • Properties with consent to be demolished within a 2 year period.
  • Industrial and agricultural sites that have low energy/heating demand.
  • Protected/Listed buildings that have designated environmental or historical merit.

Who carries out and produces commercial EPC's

Commercial epc certificates are generated by fully qualified commercial energy assessors. The Minimum Level of Energy Efficiency (MEES)

The Regulations set out the minimum level of energy efficiency for private rented property in England and Wales. In relation to the non-domestic private rented sector, Part 3 of the Regulations contains the minimum level of energy efficiency provisions, which is currently set at an energy performance certificate (EPC) rating of at least band E. As band E is a minimum, landlords who are installing relevant energy efficiency improvements may also wish to aim above and beyond the current requirement in order to achieve greater energy savings.

The minimum level of energy efficiency provisions will mean that, subject to certain requirements and exemptions:

a) from 1 April 2018, landlords of non-domestic private rented properties (including public sector landlords) may not grant a tenancy to new or existing tenants if their property has an EPC ratingofband F or G (shown on a valid Energy Performance Certificate for the property).

b) from 1 April 2023, landlords must not continue letting a non-domestic property which is already let if that property has an EPC rating ofband F or G.
